The deal, in language you can hold us to.
Written to be read rather than to be survived. Where a term protects us and not you, it says so plainly instead of hiding in a long sentence.
1. Who is agreeing
“We” and “us” means WONS, which operates WONS Sites, based in Thimphu, Bhutan. “You” means the person or organisation with the account. Creating an account means agreeing to this and to the privacy policy.
If you are signing up for an organisation, you are confirming you are allowed to agree on its behalf.
2. What we provide
A dashboard where you write and manage a website's content, a catalogue of designs, and an API that serves that content and those designs to whatever address your site is published at.
We aim to keep it available continuously. We do not promise a specific uptime percentage, because a number we cannot back with a refund policy would be decoration. What we do promise: if we break your site, fixing it is our problem and our cost, and we will tell you what happened.
3. Your account
- Keep your password to yourself. Anything done with your credentials is treated as done by you.
- Give us an email address that works. It is how we reach you about your subscription, your site, and anything urgent.
- One person or organisation per account. Plans that allow several sites say so.
4. Your content stays yours
Everything you put here — your words, your photographs, your logo, your data — remains yours. We claim no ownership of it.
You give us permission to store it, process it and serve it to the public, because that is the entire service and we cannot publish a website without it. That permission ends when you delete the content or close the account.
You are responsible for having the right to publish what you upload. If you put someone else's photograph on your site, that is between you and them.
5. What you may not publish here
We will suspend a site that is used for:
- Anything unlawful under the law of Bhutan.
- Impersonating a person, business or public body.
- Malware, phishing, or pages built to deceive people into handing over credentials or money.
- Content that sexualises children. This one ends the account and is reported.
- Harassment of an identifiable person, or incitement of violence against a group.
- Bulk unsolicited email, or a site that exists to support it.
- Reselling access to your dashboard to people who should have their own accounts, on a plan not intended for it.
Where a judgement call is close, we would rather ask you than pull a site down. Where it is not close — the fourth item especially — we act first.
6. Advertising on free plans
A free site carries advertising, and that is what funds it. By using a free plan you agree to adverts being shown on your pages, and you agree not to hide, obscure, reposition or artificially click them.
We keep advertising to placements that leave your content readable, and we do not put more advertising on a page than there is content. Any paid plan removes network advertising, starting at the cheapest one — that is the honest way to escape it, rather than trying to break it.
7. Paying
Plans and periods
Paid plans are bought for a fixed period, stated in Ngultrum at the time of purchase. The plan you are on and what it includes are shown in your dashboard.
When a subscription lapses
Your site stops being served and shows a maintenance notice instead. It is not deleted, and your content is not touched. Renew and it returns as it was. We will tell you before this happens, not after.
Refunds
If a payment was taken and the thing you paid for was not delivered, that is our error and we return it. If you change your mind about a plan you have been using, we will look at it case by case and we would rather talk than argue over a rule.
Price changes
We can change prices. A change never applies to a period you have already paid for, and we will tell you before a renewal at a new price.
8. Domains
A free address on our own domain is provided as part of the service and remains ours; we can reclaim one that is unused, abusive, or misleading about who runs it.
A domain you register is yours, from your registrar, and nothing here gives us a claim on it. We will help you point it at your site. We are not your registrar and we cannot renew it for you — that responsibility stays with you, and a lapsed domain takes your site off the internet no matter what you have paid us.
Some short or valuable free addresses are sold rather than given away, and are marked as such before you choose one.
9. Themes
Using a theme gives you the right to use it on your site while your plan allows it. It does not give you the right to redistribute or resell the theme's files.
A theme built specifically for you under a commission is covered by whatever we agree in writing at the time, which takes precedence over this section.
10. Ending it
By you
Any time. Ask us to close the account and we will, and your content goes with it. Take a copy first — your site's data is available to you as JSON at any time, and once it is deleted we cannot get it back for you.
By us
We may suspend or close an account for a breach of section 5, for non-payment, or where continuing to serve a site would put us or our other customers at legal risk. Except where the law or the seriousness of the breach prevents it, we will tell you why and give you a chance to put it right.
11. The parts that protect us
The service is provided as it is. We do not warrant that it will be uninterrupted or error-free, and we are not liable for indirect or consequential losses — lost profits, lost business, lost opportunity — arising from its use.
Where we are liable, our total liability is limited to what you have paid us in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded.
We say this plainly rather than in capital letters across three paragraphs, because the intention is the same and one of those is readable.
12. Changes to these terms
We may update these terms. The date at the top changes when we do. For a change that materially affects you we will tell you rather than rely on you noticing, and continuing to use the service afterwards means accepting it.
13. Law
These terms are governed by the law of Bhutan, and the courts of Bhutan have jurisdiction over any dispute.
14. Reaching a human
Write to hello@wons.bt or use the contact form. A person answers.
